Sam Driscoll Therapy is the name under which I, Sam Driscoll, provide counselling and psychotherapy as a sole trader.
I am responsible for deciding how and why personal information is used.

What this notice covers
This notice explains how I handle information collected through this website, the contact form and any correspondence before therapy begins.
If you become a client, relevant information from your enquiry may become part of your client record. I will then provide a separate privacy notice explaining how information connected with your therapy is handled.
What information I collect
When you contact me, I may collect:

your name;

your email address and telephone number;

how you would prefer to be contacted;

whether you are interested in online or in-person therapy;

anything you choose to share about what has brought you to therapy;

any questions you ask; and
-
subsequent correspondence between us.
What you share may include information about your physical or mental health, relationships, identity or other sensitive aspects of your life. This information receives additional protection under data-protection law.
Wix may also collect technical information when you visit the website, such as your IP address, browser, device, approximate location and how you interact with the site.
Most of the information I hold comes directly from you. You are not legally required to provide it, but I need some contact information to respond to an enquiry.
How I use your information
I use your information to:

respond to your enquiry;

answer your questions;

consider whether I may be able to offer an appropriate service;

arrange an initial conversation or introductory session;

maintain a reasonable record of our communication;

protect the security of my website and practice; and

meet legal, professional or safeguarding responsibilities where necessary.
I do not use enquiry information for marketing or add people to a mailing list.
I do not use automated systems to decide whether I can work with you.
The legal reasons for using your information
I generally use enquiry information because you have asked me to take steps towards potentially providing therapy. This is covered by Article 6(1)(b) of the UK GDPR.
I may also use information where necessary to meet a legal obligation or for the legitimate administration and protection of my practice.
Information about physical or mental health and other sensitive matters is treated as special-category information. I use this only where permitted for the provision of therapy or related care, and under a professional duty of confidentiality.
In unusual circumstances, information may also be used where necessary to protect someone from serious harm, address a safeguarding concern or establish, exercise or defend a legal claim.
Wix, Google and website information
The website is hosted by Wix. Enquiries submitted through the contact form are stored within Wix Forms, and I receive a copy through my Google Workspace email account.
Wix and Google process information on my behalf to provide these services. They may process information outside the United Kingdom. Where this happens, they state that they use recognised legal safeguards to protect the information.
The website also uses cookies. Essential cookies help it function securely, while optional cookies are controlled through the cookie banner. More information is available in my Cookie Policy.
When information may be shared
I do not sell personal information.
I will not ordinarily share enquiry information with anyone else. However, relevant information may be disclosed where reasonably necessary to:

comply with the law or a court order;

respond to an immediate and serious risk of harm;

address a safeguarding concern; or
-
obtain advice from an insurer, legal adviser or professional body in connection with a complaint or legal claim.
I will only share information that is relevant and necessary. Where it is appropriate and possible, I will discuss this with you first.
How long I keep enquiry information
If your enquiry does not lead to therapy, I will normally keep it for six months after our last contact. It will then be deleted from my active records unless there is a clear legal, safeguarding or professional reason to retain it for longer.
Wix and Google may retain limited backup copies temporarily under their own deletion processes.
If you become a client, relevant information may be transferred to your client record and kept in accordance with the separate client privacy notice.
How I protect your information
I take reasonable steps to protect information from loss, misuse or unauthorised access. Access is restricted, and the services I use provide measures such as account protection and encrypted transmission.
No form of electronic communication can be guaranteed to be completely secure. For this reason, please share only what feels necessary when making an initial enquiry.
Your rights
Depending on the circumstances, you may have the right to:

ask what personal information I hold about you and receive a copy;

correct information that is inaccurate or incomplete;

ask for information to be deleted;

ask me to restrict how information is used;

object to a particular use of your information; and
-
receive information you provided in a portable format.
These rights are not absolute and may not apply in every circumstance. If I cannot comply with a request, I will explain why.
You have a particular right to object where I rely on legitimate interests. If you object, I will stop that use unless there is a compelling lawful reason to continue or the information is needed in connection with a legal claim.
